Article 1. Applicability

1.1. These general terms and conditions apply to all purchases made and agreements concluded by individuals, hereinafter referred to as "customers" or "buyers," with ANCH bvba (trading name BABBEDIBOE), KBO BE 0655.791.660, with its registered office located at 2940 Stabroek, Akkerstraat 116, hereinafter referred to as "BABBEDIBOE" or "seller."

1.2. By entering into an agreement or placing an order, the buyer acknowledges having read and fully accepted these terms and conditions.

1.3. These terms and conditions apply exclusively to natural persons purchasing goods for private purposes. Customers and BABBEDIBOE agree that their relationship is exclusively governed by these general terms and conditions, excluding all previously described conditions on the website. If an application, order, assignment, or order confirmation from the buyer contains provisions that conflict with these terms, such provisions shall only apply if explicitly accepted in writing by the seller.

1.4. These terms outline the process for placing an order, making payments, delivery methods, and the service provided.

Article 2. Formation of the Contract and Ordering Process

2.1. All information or proposals provided by the seller, in any form, are entirely non-binding and do not constitute a contractual offer. The order placed by the buyer based on such information constitutes an offer to contract.

2.3. The agreement concluded online between the buyer and the seller will be printed and kept at the registered office of the seller for a period of one year. It is available upon written request by the buyer.

2.4. Agreements between the seller and the buyer are governed by Belgian law.

Article 3. Delivery

3.1. Delivery costs are automatically calculated by the website. Babbediboe utilizes Bpost services. Once your package has been collected by the carrier, you will receive an email with the tracking number to monitor the shipment. Orders over €50 are shipped **free of charge** within Belgium and the Netherlands. For orders below this amount, shipping costs are approximately €5 within Belgium and approximately €7.50 to the Netherlands, France, Luxembourg, and Germany, depending on the selected delivery option.

3.2. The delivery period begins at the moment of order placement by the buyer. Any stated delivery periods are purely indicative and approximate. The average delivery time for available products is **3 to 4 days**.

3.3. The costs for returning a product to Babbediboe are always borne by the customer. If the customer cannot receive the package due to, for example, absence, the package will be held at the post office. It is the customer's responsibility to collect the package within **14 days**. Otherwise, Bpost will return the package to Babbediboe. Babbediboe will resend the package to the customer upon payment of the applicable shipping cost.

Article 4. Payment

4.1. Customers can pay for their purchases via the following methods:

- Online payment.

4.2. If the invoice is not paid by the due date, all outstanding invoices become immediately payable without further notice. The outstanding amount will automatically be increased, without requiring a formal notice, by **contractual interest of 12% per year** and a **fixed penalty of 12%**.

Article 5. Complaints - Liability - Indemnity

5.1. Complaints regarding non-compliant deliveries must be submitted **by registered mail** within **2 days** of delivery; otherwise, the complaint will be considered invalid.

5.2. BABBEDIBOE has only a best-efforts obligation regarding access to the website, order processing, delivery, and other services. BABBEDIBOE **cannot be held liable** for any inconveniences or damages resulting from internet use, including system failures, outsider intrusions, viruses, or any circumstances legally considered force majeure.

Article 6. Retention of Ownership

6.1. All delivered products remain the property of the seller **until fully paid**.

Article 7. Withdrawal in Case of Distance Sales

7.1. The customer has the right to notify the seller that they are **withdrawing from the purchase**, without penalty and **without providing a reason**, within **14 working days** following the delivery of the product or the conclusion of the service agreement.

7.2. The direct costs for returning the goods in case of withdrawal shall **be borne by the buyer**.

7.3. Withdrawal is **not possible** if the purchased items have been **damaged or soiled**.

Article 8. Termination of the Agreement

8.1. If the agreement is terminated by the buyer, they will automatically owe the seller a **fixed penalty of 12%** of the purchase price, without prejudice to the seller's right to prove and claim higher damages.

Article 9. Privacy

9.1. The buyer can freely browse available goods and services and their respective prices without **registration** or the exchange of personal data.

9.2. When the customer performs certain activities on the website, such as ordering products, responding to messages, or participating in competitions, Babbediboe requires specific personal data. This is done by filling out and submitting an **online form**. There is **no obligation** for the customer to participate. Babbediboe collects this information to facilitate the customer's participation and provide benefits such as technical support, discounts, and other offers.

9.3. Personal data collected by BABBEDIBOE **will never be shared** with third parties, except when strictly necessary for **transportation** services.

9.4. The buyer has the **right to access and correct** their personal data by submitting a simple written or electronic request.

9.5. The buyer has the **right to object to** the processing of their data and request **deletion** of personal data via written or email request.

Article 10. Integrity

10.1. If any clause of these terms is found **invalid**, the validity of the remaining provisions **remains unaffected**.

Article 11. Proof

11.1. The **electronic records** maintained in BABBEDIBOE’s system serve as evidence of communications, orders, and payments between parties.

Article 12. Disputes

12.1. Any disputes relating to the **formation, execution, interpretation, or termination** of agreements between BABBEDIBOE and the customer are subject to **Belgian law** and fall under the **exclusive jurisdiction** of the Courts of the Antwerp district.
